This Privacy Policy describes how Pride Manufacturing Company LLC d/b/a GATHR Outdoors (collectively, “GATHR”) collects and uses Personal Information about you through the use of our Services, and through email, and other electronic communications between you and GATHR.
GATHR, and its Affiliates (“GATHR”, “We” or “Us”) wants you to be familiar with how we collect, use and disclose information. This Privacy Policy (our “Privacy Policy”) describes our practices in connection with information that we collect through:
- Websites operated by us from which you are accessing this Privacy Policy (collectively, the "Websites”);
- Email, telephone and other electronic messages between you and us; and
- Our Stores when you visit us in person.
This Privacy Policy does not apply to information collected by:
- us offline or through any other means, including on any other website operated by GATHR or any third-party; or
- any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website.
Collectively, we refer to the Websites emails, and offline business interactions as the “Services.”
If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using this Website, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see the “UPDATES TO THIS PRIVACY POLICY” Section of this Privacy Policy). Your continued use of our Websites after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.
DATA CONTROLLER, DATA PROTECTION OFFICER, AND REPRESENTATIVE
GATHR is the data controller of the Personal Information you provide through the Services. At this time, GATHR is not required to appoint a Data Protection Officer or a representative. GATHR will update this Privacy Policy if it does.
At this time, GATHR is not required to appoint a Data Protection Officer or a representative in the EU, and has elected not to do so. GATHR may be contacted in any manner set forth below in the “CONTACT INFORMATION” Section of this Privacy Policy.

GATHR Affiliates includes all GATHR subsidiaries and affiliates.
GATHR subsidiaries and affiliates include, but are not limited to: Pride Manufacturing Company LLC, PrideSports, MacNeill Pride Group Corporation, Softspikes, LLC, Argon Technologies, Inc. (d/b/a KLYMIT), Rightline Gear LLC, GCI Outdoor LLC, ORCA Coolers, WaterPort LLC, and Cascadia Vehicle Tents LLC (“Affiliates”).
INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
We collect different types of information about you, including information that may directly identify you, information that is about you but individually does not personally identify you, and information that we combine with our other users. This includes information that we collect directly from you or through automated collection technologies.
“Personal Information” is information that identifies you as an individual or relates to an identifiable individual, information that is about you individually, but does not identify you, and information about your internet connection, the equipment you use to access our Services and usage details. The Services collect Personal Information, including:
- Name;
- Postal address (including billing and shipping addresses);

- IP address (we may also derive your approximate location from your IP address);
- Account information, such as username and password;
- Payment card data;

COLLECTION OF PERSONAL INFORMATION
We and our service providers collect Personal Information in a variety of ways, including:
- Through the Services.
- We collect Personal Information on or through the Services, for example, when you sign up to receive updates, special promotions or newsletters from us, register an account to access the Services, visit our stores, attend one of our events, contact customer service, place an order over the phone, or make a purchase.
- We also receive the following information from our third party Short Message Service (SMS) provider: your mobile phone number when you send a text message to us and the text messages you send to us.
- Automatically through our Website.
- Usage and Equipment Information. As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, for example, details of your visits to our Website, such as traffic data, location, logs, referring/exit pages, date and time of your visit to our Website, error information, clickstream data, and other communication data and the resources that you access and use on the Website, and information about your computer, mobile device, and Internet connection, specifically your IP address, operating system, and browser type.
- Location Information. This Website collects real-time information about the location of your device. You can choose whether or not to allow the Website to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Website may then be inaccessible or not function properly. - The information we collect automatically may include Personal Information or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better and more personalized service by enabling us to estimate our audience size and usage patterns, store information about your preferences, allowing us to customize our Website according to your individual interests, and to recognize you when you return to our Website.
- The technologies we use for this automatic data collection may include:

Pages of our Websites and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit GATHR, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
- Third-Party Use of Cookies and Other Tracking Technologies.
- Third Party Cookies. Some content or applications, including advertisements, on our Websites are served by third-parties, including our third-party marketing partners, including advertisers, ad networks and servers, content providers, application providers, and social media sites. With your consent, these third parties may use cookies (alone or in conjunction with web beacons or other tracking technologies) to collect information about you when you access our Websites. The information they collect may be associated with your Personal Information or they may collect information, including Personal data, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising and other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about advertisement or other targeted content, you should content the responsible provider directly
- Google Analytics. We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of our Websites. Google Analytics uses cookies to help our Websites analyze how users use the site. We also use Closed Circuit TV cameras to collect and retain for a limited duration images of our customers in our stores for fraud detection, theft prevention and security.
LAWFUL BASIS FOR PROCESSING YOUR PERSONAL INFORMATION
We have a lawful basis for our processing of your Personal Information, including processing for our legitimate interests (when balanced against your rights and freedoms), to fulfill our obligations to you under a contract with you, and required by law, and with your consent.
If you are in the European Union, the processing of your Personal Information is lawful only if it is permitted under the applicable data protection laws. We have a lawful basis for each of our processing activities (except when an exception applies as described below):
- Consent. By using our Services, you consent to our collection, use, and sharing of your Personal Information as described in this Privacy Policy. If you do not consent to this privacy Policy, please do not use the Services;
- Legitimate Interests. We will process your Personal Information as necessary for our legitimate interests. Our legitimate interests are balanced against your rights and freedoms and we do not process your Personal Information if your rights and freedoms outweigh our legitimate interests. Our legitimate interests are to: facilitate communication between GATHR and you; detect and correct bugs and to improve our Services; safeguard our IT infrastructure and intellectual property; detect and prevent fraud and other financial crime; promote and market our business; check your credit and perform risk assessments; and develop our product and services;
- To Fulfill Our Obligations to You under our Contract. We process your Personal Information in order to fulfill our obligations to you pursuant to our contract with you to deliver our products to you.
- As Required by Law. We may also process your Personal Information when we are required or permitted to by law; to comply with government inspections, audits, and other valid requests from government or other public authorities; to respond to legal process such as subpoenas; or as necessary for us to protect our interests or otherwise pursue our legal rights and remedies (for instance, when necessary to prevent or detect fraud, attacks against our network, or other criminal and tortious activities), defend litigation, and manage complaints or claims.

DISCLOSURE OF PERSONAL INFORMATION
We do not share, sell, or otherwise disclose your Personal Information for purposes other than those outlined in this Privacy Policy. We may disclose your Personal Information on a need to know basis, as listed below:

All payment transactions are performed by our third-party payment processor, who must comply with appropriate industry standards to protect your payment information.

YOUR CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION
We strive to provide you with choices regarding the Personal Information you provide to us. We have created the following mechanisms to provide you with control over your Personal Information.
We do not control the collection and use of your information collected by third parties described above in the “DISCLOSURE OF PERSONAL INFORMATION” Section of this Privacy Policy. When possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. These third parties may, however, aggregate the information they collect with information from their other customers for their own purposes.
Correct or update your information. If you would like to request changes to Personal Information that you have previously provided to us to ensure that it is complete, accurate, and as current as possible, please contact us by mail, email, or telephone using the “CONTACT INFORMATION” below. You can also review and change your Personal Information by signing into your account and visiting your "My Account" page. Please note that we may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect
Opt-out of email communications. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by using the opt-out mechanism contained in each such email. Please allow 10 days for the change to take effect. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt-out.
Opt-out of text communications. You can opt-out of receiving further marketing text messages via the Messaging Service by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. By signing up via text, you agree to receive recurring automated marketing text messages from GATHR Mobile Alerts at the cell number used when signing up. Consent is not a condition of any purchase. Msg & data rates may apply. GATHR Mobile Alerts program is valid in the U.S. only.
Opt-out of physical mail communications. If you no longer want to receive physical mail or catalogs from us on a going-forward basis, please contact us by mail, email, or telephone using the "CONTACT INFORMATION" below.
Withdraw your consent and close your online account. To the extent that our processing of your Personal Information is based on your consent, you may withdraw your consent at any time by closing your GATHR.com account and removing your name from our marketing lists. Withdrawing your consent will not, however, affect the lawfulness of the processing based on your consent before its withdrawal, and will not affect the lawfulness of our continued processing that is based on any other lawful basis for processing your Personal Information. Tracking Technologies and Advertising. Some content or applications, including advertisements, on our websites, are served by third parties, including advertisers, ad networks and servers, content providers, application providers, and social media sites. We may use "cookies", "web beacons" and other similar technologies to collect information in connection with our services and our advertisements. You may withdraw or change your consent at any time by selecting "Cookie Settings" in the Privacy & Compliance section of the website footer. We do not control third parties collection or use of your information to serve interest-based advertising. RETENTION PERIOD
We retain your Personal Information for as long as you keep your account open. In some instances, we may keep it after you close your account, for example we may keep it:
- on our backup and disaster recovery systems;
- for as long as necessary to protect our legal interests; and
- and to comply with other legal requirements.
We retain Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law.
The criteria used to determine our retention periods include:
- The length of time we have an ongoing relationship with you and provide the Services to you (for example, for as long as you have an account with us or keep using the Services);
- Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or

This Privacy Policy does not apply to information collected by third party websites that may be accessible through the Services.
This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.
In addition, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM, or any other social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with our Social Media Pages.
AUTOMATED DECISION-MAKING
We generally do not use your Personal Information with any automated decision-making processes that produce legal or similarly significant effects.
Our service providers may use techniques like machine learning (European law refers to this as “automated decision-making”) to help us improve our services. When our service provider uses such machine learning, it either: (1) still has a human being involved in the process (and so is not fully automated); or (2) uses machine learning in ways that do not have significant privacy implications, for example, reordering how apps might appear when you visit the online store (and so does not produce legal effects or similarly significant effects).
DO NOT TRACK SIGNALS
We may use automated data collection technologies to track you across websites. We currently do not honor do-not-track signals that may be sent by some browsers.
We also may use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. Because there is no standard for these signals at this time, we currently do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.
USE OF SERVICES BY MINORS
Our Services are not intended for children under the age of 16 and children under the age of 16 are not permitted to use our Services. We will remove any information about a child under the age of 16 if we become aware of it.
The Services are not intended for individuals under the age of 16, and we do not knowingly collect Personal Information from individuals under 16. If you are under 16, do not register for Services, make any purchases through the Services or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. JURISDICTION AND CROSS-BORDER TRANSFER
We may process your Personal Information outside of your home country, including to or from the United States. When we transfer Personal Information outside of your home country, we provide appropriate safeguards to protect your Personal Information.

SENSITIVE INFORMATION
We generally do not request you provide and do not process any special categories of Personal Information.
GATHR does not ask you to provide, and we do not knowingly collect, any special categories of Personal Information from you. Unless we request it, we ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Services or otherwise to us.
THIRD PARTY PAYMENT SERVICE
We may disclose Personal Information to third-party payment processors. If you make a payment through the Services, your Personal Information is subject to the third party’s privacy policy.
We may use a third-party payment service to process payments made through the Services. If you wish to make a payment through the Services, your Personal Information will be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use, and disclosure of your Personal Information. GATHR PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice for California Residents supplements the information contained in GATHR’s Privacy Policy that this is attached to and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice. We may update this Privacy Notice for California Residents as necessary and in the event of changes in the CCPA.
INFORMATION WE COLLECT
Our Website and your participation in GATHR’s discount programs, collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”).
CATEGORIES OF PERSONAL INFORMATION GATHR HAVE COLLECTED IN THE PRECEDING 12 MONTHS:
CONSUMERS. Pursuant to the CCPA, we are providing the following chart detailing which categories of Personal Information about California residents (other than employees, job applicants, contractors, dependents or beneficiaries) we collect, disclose, and/or sell.

WE MAY USE OR DISCLOSE THE PERSONAL INFORMATION WE COLLECT FOR ONE OR MORE OF THE FOLLOWING BUSINESS PURPOSES:
- To fulfill or meet the reason you provided the information. For example: if you share your name and contact information to ask a question about our products, we will use that Personal Information to respond to your inquiry; if you provide your Personal Information to order products, we will use that information to process your payment and facilitate fulfilling your order. We may also save your information to facilitate your participation in GATHR discount programs and future orders.
- To provide, support, personalize, and develop our Website, products, and support services.
- To create, maintain, customize, and secure your online account or other programs with us.
- To process your requests, purchases, transactions, and payments and prevent transactional fraud.
- To provide you with support and to respond to your inquiries.
- To personalize your Website experience and to deliver content and product and support offerings relevant to your interests, including targeted offers and ads or otherwise through our Website, third-party sites, and via email (with your consent).
- To help maintain the safety, security, and integrity of our Website, products, databases and other technology assets, and business.
- For testing, research, analysis, and product development, including to develop and improve our Website, products and support services.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- As described to you when collecting your Personal Information or as otherwise set forth in the CCPA.
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of GATHR’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by GATHR about our customers are among the assets transferred.
GATHR will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
SHARING PERSONAL INFORMATION
GATHR may disclose and sell your Personal Information to a third party for one or more business purposes. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

YOUR RIGHTS AND CHOICES
The CCPA provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.
Access Request Rights
You have the right to request that GATHR disclose certain information to you about our collection and use of your Personal Information over the past 12 months for the above business and commercial purposes. To submit an access request, see the Section “Exercising Access and Deletion Rights.” Once we receive and confirm your verifiable consumer request, we will disclose to you:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- Our business or commercial purpose for collecting that Personal Information.
- The categories of third parties with whom we share that Personal Information.
- The specific pieces of Personal Information we collected about you.
- If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:
- sales, identifying the Personal Information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that GATHR delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless certain exceptions apply. Exercising Access and Deletion Rights
To exercise the access and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

NON-DISCRIMINATION
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties. However, we will continue to offer you discounts and other benefits if you choose to participate in GATHR discount programs.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
NOTICE OF FINANCIAL INCENTIVE
GATHR may offer you certain loyalty and rewards programs that may be considered financial incentives program under the CCPA, which can result in different prices for GATHR products and merchandise, such as our military and first responder program. Eligible members of our discount programs may save a discount off of eligible products, the details of which will be provided at the time you sign up for the program, if you are eligible. Participation in our discount programs is voluntary, and requires your prior opt in consent. If you elect to participate, you may do so through the “My Account” page or by performing certain voluntary interactions with our Website. While we will not discriminate against you for exercising your rights under CCPA, if you request deletion of your data, any accumulated points will be deleted and you may not have access to continued discounts and benefits of membership. You may cancel membership at any time, subject to certain restrictions.
GATHR requires minimal Personal Information in order to provide the price discounts to eligible participants, including the following categories of Personal Information: identifiers, California customer records Personal Information categories, professional and employment-related information as further detailed in the Section “INFORMATION WE COLLECT” above. GATHR uses the Personal Information of eligible participants to provide the discounts and to further our business in accordance with our Privacy Policy. The value GATHR receives from our discount programs (and its incidental collection of consumer Personal Information) includes the profits generated by, and the consumer good will and consumer relationship established through, the offering of the GATHR discount programs, and taking into account the costs to GATHR to provide and maintain our discount programs. The value will be disclosed to you at the time you sign up for the applicable program.

OTHER CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83 (California’s “Shine the Light” law) permits users of our Website that are California residents and who provide Personal Information in obtaining products and services for personal, family, or household use to request certain information regarding our disclosure of Personal Information to third parties for their own direct marketing purposes. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we shared your Personal Information with for the immediately prior calendar year (e.g. requests made in 2020 will receive information regarding such activities in 2019).
